We intend to process your personal data in a lawful, fair, and transparent manner. In this privacy statement, we explain which personal data about you, as an individual, we process and the purposes of processing. Additionally, we provide explanations about your rights to ensure and potentially enhance the protection of your data.

 

1. Who are we?

 

Your data is processed by Agilitas Group, headquartered at Stationsstraat 120, 2800 Mechelen, and registered with the Crossroads Bank for Enterprises under number 0478.971.449.

Within our organization, data is only accessible to responsible individuals who require it based on their job duties.

2. What personal data do we collect?

Agilitas occasionally processes public data.

 

This may include data that is subject to a publication requirement, such as the publication of your appointment as a company director, or data you have made public yourself, such as information on your website, etc.

 

It may also include data that is public, for instance, because it is well known in your area or because it has appeared in the press. Examples include information published by the Crossroads Bank for Enterprises and Graydon.

When you contact us by phone, our receptionist may record your name, first name, and phone number to create a contact record and keep a record of people contacting our services.

 

3. For what purposes do we collect your personal data?

 

Depending on the situation, Agilitas needs certain information about you to provide certain services. The information Agilitas collects and through which we can identify you is referred to as personal data.

Below, you can see, depending on the situation, why Agilitas collects this personal data and for what purposes your personal data will be used.

Your data is used, depending on the case, for the following purposes:

  • For contact persons at clients or prospects during a first contact with Agilitas: your data is necessary for us to properly execute the contract you conclude with us. Since you conclude a contract with us, we need to have the necessary personal data to provide the services stipulated in the contract.

This mainly concerns data that is necessary to exchange information with you regarding the provision of temporary workers.

The personal data collected will be processed administratively and for accounting purposes. If you do not want your personal data processed in this context, it will not be possible to carry out the services for which you have entered into a contract with us.

  • New potential contacts who have left their business card: if you have, in any way, given us a business card, we record you in our database. Since you have provided us with your contact information, we assume that you consent to this entry in our database.

Additionally, we also store in our database any publicly accessible data about you. We assume we are authorized to retain this personal data since you have made it public.

 

 

4. Automated decision-making and/or profiling

 

Agilitas uses your personal data to make decisions based on the automated processing (including profiling) of your personal data.

Agilitas applies the following underlying logic regarding the aforementioned automated decision-making: based on the offer we made, we analyze the offer, how you view this offer, and whether you accept the proposal.

The aforementioned automated profiling serves the following interest of the individual concerned: It helps us optimize the offer we make to you, now and in the future. Additionally, we use automated profiling to improve the offers issued.

Based on the aforementioned automated decision-making, the following consequences can be expected for the individual: none.

 

5. Who receives my personal data?

 

In principle, your personal data is not transmitted to third parties.

Agilitas processes this personal data in line with the purposes mentioned in point 3. Only our organization’s employees who need your personal data in the course of their duties can access it.

When organizing events, we may transmit your personal data (such as your first and last name) to organizers, solely for organizational and security reasons.

We work with several third parties who may also access your personal data. These are the following recipients:

  • Accountants & tax consultants
    IT service providers

 

6. How long is my personal data retained?

 

Your personal data is kept for as long as necessary to fulfill the purposes described in point 3.

Naturally, we retain your personal data in line with any legal retention and statutory limitation periods. For example, for invoices, the retention period is 7 years.

 

7. What rights do I have to ensure the protection of my personal data?  

 

7.1. You can access your data

 

If you wish to view the personal data we process about you, you can do so by exercising your right of access.

Agilitas will provide you with as complete a summary as possible of the personal data we retain about you. We can already confirm that we do not retain any special categories of personal data (e.g., data related to race, ethnic origin, health, sexual orientation, etc.).

You can obtain a copy of the personal data collected.

 

7.2. You can have your data corrected

 

If there are changes to your personal data (name, address, email address, etc.), you can always request that these be corrected or supplemented.

 

7.3. You can request the deletion of your data

 

If you believe we are processing certain personal data unlawfully, that is, without a legitimate purpose, you can request that your personal data be deleted from our files.

 

7.4.   You can request the restriction of the processing of your personal data

 

If your personal data is inaccurate and you have requested an update, or if you believe we are processing your data unlawfully, you can request to restrict its processing.

This means that we may only continue processing your personal data with your consent. We can certainly continue to retain your data, but we may not proceed with processing without your consent, except in the context of legal proceedings, for the protection of individuals, or for important public interest reasons.

 

7.5. You can request that your personal data be transferred directly to a third party 

 

If you wish, you can request us to transfer the data you have personally provided, either to yourself or directly to a third party. The Regulation provides specific limitations on this right, so it does not apply in all cases. A case-by-case review is, of course, necessary.

 

7.6. You can sometimes refuse automated processing of your data 

 

If you disagree with such an automated process, you can exercise a right to object, so that your personal data is no longer processed in this way.

7.7. You can withdraw your consent

 

When your personal data is processed based on your consent (see point 3), you can withdraw this consent at any time. We would then be required to delete your data.

Additionally, please note that you may file a complaint with the supervisory authority if you believe we do not respect your rights as stated above.
